Excise Scam: SC lets Sanjay Singh leave jail

The Supreme Court on Tuesday granted jailed Aam Aadmi Party (AAP) leader Sanjay Singh a bail during the pendency of a trial after the Enforcement Directorate said it had no objections.

Singh, a Rajya Sabha MP, was arrested on October 4, 2023 in the ongoing money laundering probe in the Delhi excise policy scam case.

A bench of Justice Sanjiv Khanna, Justice Dipankar Datta and Justice P B Varale remarked earlier that he has spent six months in jail. “Singh spent six months in jail. The allegation of him receiving Rs 2 crore bribe can be tested during the trial,” SC said.

The SC has asked Singh to not make any comments on the case. The bench said Singh will remain out on bail during the course of the entire trial and that the terms and conditions for the bail will be fixed by the special court.

The bench said the concession of bail granted to Singh will not be treated as “precedent”. Consequently this bail order may not be of much help to other jailed AAP leaders, including Delhi Chief Minister Arvind Kejriwal who is currently in judicial custody in the same case.

During the hearing, senior advocate Abhishek Singhvi, appearing for Singh, said the AAP leader was arrested on the basis of approver Dinesh Arora, who in the tenth statement recorded before the agency has named him.

Singh originally asked for a bail as he was in custody for over three months and no role was attributed to him in the offence. Opposing his bail plea, ED told the Delhi HC that Singh was involved in acquiring, possessing, concealing, dissipating and using proceeds of the crime generated from the Delhi liquor scam pertaining to the policy period of 2021-22.

The agency also alleged that the AAP leader had unlawfully acquired funds or kickbacks that stem from the liquor policy scam and asserts that he conspired with the other leaders.

“The bail to Sanjay Singh has exposed that the ED case on liquor scam was based on statements extracted from witnesses and approvers. This is a big day for democracy in the country, it is a moment of happiness and hope,” AAP said.

Delhi minister Atishi shared the news of Singh’s bail in a post on X and said in Hindi, “Satyameva Jayate.”
